Marthinus Yohame, Indonesia Judged Violating the United Nations Universal
Declaration of Human RightsSolidarity with Victims of
Human Rights Violations (SKP-HAM) Papua, assess, Indonesia has violated a
number of national rules and international related deaths Chairman of the
National Committee of West Papua (KNPB) Sorong Kingdom, Marthinus Yohame, in mid-August.
Peneas Lokbere,
Coordinator of SKP-HAM Papua detailing, first, as mandated by the Universal
Declaration of Human Rights (UDHR) United Nations, Article 5, which reads,
"No person may be tortured or treated cruelly, treated or punished
inhuman, or contemptible" , chapter 9, "No one shall be arrested,
detained or arbitrarily discarded."
In addition,
continued Lokbere, Indonesia also had violated Law No. 39 of 1999 on Human
Rights (HAM), pasasl 33, paragraph (1) reads, "Every person has the right
to be free from torture, or cruel pengukuman, not inhuman and degrading human
dignity. "
Also, in violation
of paragraph (2) which reads, "Every person has the right to be free from
enforced disappearance and the disappearance of lives."
And more fatal,
further Lokbere, human rights protection is also regulated in Law Number 21 of
2001 on Special Autonomy for Papua, Article 45 reads, "The Provincial
Government and the people of Papua Province shall uphold, promote, protect and
respect human rights in Papua. "
"If we see,
Indonesia has violated the rules of national, international, and even the rules
set by the Special Autonomy Law. Therefore we ask the attention of the
international community, in this case the United Nations, "said Lokbere.
Meanwhile, Agus
Kosay, Vice Chairman of KNPB revealed, since the beginning, the family
prohibits police officers investigating the deaths Marthinus Yohame.
"The police
justified because there is no autopsy, but since the body was found the morning
of August 26, 2014, they kasi let alone in the hospital until the afternoon,
after the family was going to take the bodies, they asked to be taken back to
the hospital for autopsy, this does not make sense," he said.
According Kossay, if a
serious police investigation into the death Yohame, should perform an autopsy
since the body was found, and not grounded in the mass media.
"We also reject
the police to investigate because it has thousands of lives of people of Papua,
especially members of the KNPB who was shot in front of the eye, but never did
an investigation," he said.
Kossay described,
there are many cases that are not handled by the Indonesian police, such as
lightning murder case against the Vice Chairman of KNPB, Mako Tabuni Moses
(31), on June 14, 2012, in Housing III, Abepura, Papua.
Shooting case against
Hubert Mabel(32), members of the KNPB on December 16, 2012, in Wamena, Papua,
by the Police Resort Wamena.
Then, cases of
extrajudicial killings against Terijoli Weya (23), Higher School of Economics
student (STIE) Port Numbay, on May 1, 2012, at 18:00 WP, in front of the Office
of Representative in 1701 Koramil Jayawijaya, Abepura, Papua.
"Next related
shootings and killings against Yesa Mirin (21), students at the University of
Paradise, on June 4, 2012, at 13:30 WP, in the village of Hope, Sentani,
Jayapura regency, Papua."
"The four cases
above, and many other cases have never done an investigation by the Indonesian
government. Occurs impunity, therefore we do not believe the Indonesian
government and Indonesian law, "he said.
